8:05 a.m. Tabletop Exercise #1

8:45 a.m. Session: Receiving and Handling Complaints
In this session, attendees will understand how to identify sexual misconduct and determine appropriate interim measures. Specific actions to take when a complaint is received and considerations for working with victims of sexual violence who are likely experiencing the effects of trauma will be covered and diversity issues will be explored.

10:15 a.m. Break

10:30 a.m. Session: Beginning an Investigation
This session will explore how to conduct investigations in a thorough and impartial manner including:

  • The mechanics of a trauma-informed investigation
  • Providing notice to parties
  • Collection of evidence
  • Note-taking
  • Handling reluctant victims
  • Interviewing witnesses and involved parties
  • Addressing confidentiality and retaliation 
  • Providing resources
  • Maintaining case files

Speakers will also provide an analysis of the predominant investigative models.

1:00 p.m. Tabletop Exercise #2

1:45 p.m. Session: Common Investigative Concerns
Speakers will provide insight and guidance on these hot topics:

  • Incapacitation vs. intoxication
  • Consent
  • FERPA exceptions
  • Relationship with the local police and MOUs

3:00 p.m. Break

3:15 p.m. Session: Writing the Investigative Report
Speakers will explore the elements of a sound report and discuss how investigators make relevance and credibility determinations to properly weigh evidence.

Day Two

8:00 a.m. Breakfast and Session: Common Adjudication Processes
This session will provide an analysis of three common adjudication models: single investigator, single adjudicator, and hearing panel. Informal mediation practices will also be covered.

10:30 a.m. Session: Conducting an Adjudication Process
Speakers will discuss best practices for handling lawyers and advocates, dealing with retaliation, and crafting remedies and sanctions. Recommendations for the notice of outcome will also be provided.

12:30 p.m. Tabletop Exercise #5

1:30 p.m. Session: Emerging Title IX Issues
This session will provide updates on recent OCR guidance. Real-life examples of institutions’ OCR investigation experiences will also be shared.
